Oshisaure's Goodies is an independant merchandise store specialising in art prints and trinkets, as well as customised commission works.

Please read these terms before making a purchase or using our services.

Changes to the terms.

When we update our terms, we will alert users by updating the modified time above, and listing in a banner on the storefront.

Rules of Conduct.

When using our platform, or providing reviews or feedback, you agree to comply with any applicable laws in your country and in the United Kingdom.

The following behaviour is forbidden:

• Interfering with the store, such as via hacking, malware, spamming, or other abuses.
• Harassing us or other users.
• Violating the rights of other users or entities.
• Acting in any way that could be considered fraudulent.
• Using offensive language, slurs, or images in reviews or comments, against us, other users, or characters we have created.
• Reproducing works or products without explicit prior written permission.

Account terms.

By creating an account or purchasing a product without an account, you agree that:

• You will adhere to these rules.
• You are at least 18 years old.
• All information provided to us is accurate and up to date, and you'll update it if it changes.
• You are solely responsiible for your account and the security and privacy of it, including passwords and sensitive information attached to it.

Intellectual Property.

Our Content.

We reserve all intellectual property rights to our content, such as artwork, images, designs, and content written by us. Users are permitted to share this content as they wish with proper atribution, but may not use it commercially, or reproduce our products (such as by creating immitation or "knock-off" products.)

Users may not make one-to-one digital replicas (such as scans) of printed works, but may share digital replicas created by us where available with proper attribution.

Your Content On Our Service.

You are not obligated as a user to provide content (images, writing, reviews, comments, feedbacks, etc) when using our platform. If you do choose to, you are responsible for ensuring that you have the rights to do so and that it is lawful. We take no responsibility for your content or for how others use it.

When you upload content to our platform, you grant us the non-transferable non-exclusive rights to:

• Use, display or perform your content.
• Redistribute your content.
• Create derivitive works of your content.
• Create new works using the characters or designs within your content, when such service is purchased.

With the limited purpose of providing our service as users would expect.

Content uploaded in a private context, such as reference sheets attached to commission purchases will not be publicly displayed on the platform or shared with other users.

We reserve the right to block, remove, or permanently delete your content if it is in breach of these terms, other aplicable policies, or applicable law.

We do welcome feedback via our contact form. By sending feedback, you grant us non-exclusive, perpetual, irrevocable, transferrable license to use the feedback and ideas generated from it without restriction, attribution, or compensation.

Third Party Content.

Our service uses content from OpenCart (https://www.opencart.com/ © OpenCart) as our site engine, and BalsamiqSans (https://github.com/balsamiq/balsamiqsans Licensed under the SIL Open Font License Version 1.1).

Users must follow the relevant service terms before using this content.

Commercial Terms.

The following goods are available, or may become available on our shop:

• Illustrated merchandise such as cards, posters, stickers, or other trinkets.
• Custom order illustration commission work.
• Hand-made physical merchandise.

We are under a legal duty to supply goods that match the descriptions of the good(s) you order on our store.

These terms apply to all goods that are displayed on the store at the time you access it. This includes all products listed as out of stock. All information, descriptions, or images that we provide about our goods are as accurate as we can make them. However we are not legally bound by such information. You agree to purchase goods at your own risk.

We reserve the right to modify, reject, or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Payments.

We only accept PayPal as a payment method at the current time.

When you provide us with your payment information, you authorise us to charge the amount due.

If we believe your payment has violated any law or these terms, we reserve the right to cancel or reverse your transaction.

Shipping.

When you purchase goods from our site, they will be delivered via Royal Mail 2nd Class (UK) or Standard International (non-UK), which generally takes between 3 to 7 business days.

Delivery will take place as soon as reasonably possible. Delivery times may vary due to unforseen circumstances.

You will be required to pay delivery charges in addition to the price of the goods.

If you are outside the UK, your purchase may be subject to import duties and/or taxes applied by your country. You are responsible for paying these. Please contact your local customs office for more information. We are not responsible for such duties and/or taxes and are not liable for any failure by you to pay them.

You must provide a complete and accurate delivery address, including name. We are not liable for the delivery of your goods to the wrong address or wrong person if you provide inaccurate information.

Commissions and Custom Work.

When you purchase custom works from us, we will do our best to complete the work and return it in a timely manner. This could take from 2 to 7 working days from the time of ordering, based on complexity, workload, and other unforseen factors. If we are unable to complete the work for any reason, we will cancel the order and provide a full refund.

You will be expected to provide an accurate email contact address at the checkout so that we can contact you about your purchase. You can also request we reach out to you via either Discord or BlueSky direct messaging should you wish to.

Right To Cancel.

If you are living in the UK or European Union, you have the right to cancel your contract to purchase goods from us within 14 days of without giving notice. This period ends 14 days after:

• You purchase digital downloadable content.
• You (or someone you nominate) receives your order, or if sent as multiple packages, the last item of your order.

To exercise your right to cancel, you must inform us of your decision within the cancellation period. To cancel, contact us by email at shop@oshisaure.wtf, or by post at Oshisaure's Goodies, Unit 160501, PO Box 7169, Poole, BH15 9E, United Kingdom.

The right to cancel does not apply to:

• Custom or personalised goods.
• Commission services and work.
• Goods that will deteriorate or expire rapidly.
• Goods designed for unsanitary or vulgar use.
• Downloadable goods that have been already been downloaded.

If you cancel your contract with us and goods have already been sent to you, then you must return the goods to us as soon as possible. You will be responsible for the cost of returning the goods. We will not be responsible for any damage or loss to the goods that occurs before they are returned to us, including while in transit.

Returns must be made to the following addresses:

• For cards and other small letter sized goods, Oshisaure's Goodies, Unit 160501, PO Box 7169, Poole, BH15 9E, United Kingdom.
• For parcels or courier delivery, Oshisaure's Goodies Unit 160501, Courier Point, 13 Freeland Park, Wareham Road, Poole, Dorset, BH16 6FH, UK.

We will reimburse to you all payments received from you under the contract, including the cost of delivery, except for any supplementary delivery charges resulting from your choice of delivery type other than the least expensive standard delivery that we offer. Please note that we are permitted by law to reduce your reimbursement to reflect any reduction in the value of goods that was caused by handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

We will provide reimbursement without undue delay and no later than the earlier of 14 days after receiving the goods supplied, or 14 days after being provided proof that you have returned them. If no goods were supplied, then that instead becomes 14 days after the decision to cancel.

We will reimburse you using the same form of payment as the initial purchase. You will not incur any fees because of the reimbursement.

Other Consumer Protection Laws

Where other consumer protection legislation in your jurisdiction applies and cannot be excluded, these terms will not limit your legal rights under that legislation. These terms will be read subject to the mandatory provisions of that legislation, and where there is a conflict, the mandatory provisions of that legislation will apply.

Liability

We will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the site.

Except where prohibited by law, by using this site, you indemnify and hold harmless us and our website from any actions, claims, losses, damages, liabilitites, and expenses including legal fees arising from your use of our site or your violations of these terms.

Applicable Law

These terms are governed by the laws of the Country of England.

Severability

If any of the provisions set forth are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed, but all other provisions will not be affected and still be considered valid.
